Last updated: 15 October 2026
This is a translation. The Spanish version is legally binding; in case of any discrepancy, the Spanish version prevails.
1. Parties and purpose
These terms govern direct bookings, through villadenava.es, of the holiday home "Oceanview Villa Señorío de Nava" (tourism register number VV-38-4-0098792). The contract is made between the guest making the booking and Francisco de Ascanio de la Vega, Tax ID (NIF) 50832694A, C/ Cornical 9, 38639 San Miguel de Abona, Santa Cruz de Tenerife, Spain, email oceanview@villadenava.es, phone +34 639 750 788.
It is a short-term stay in a holiday home for tourist purposes. It is not a residential tenancy and the property does not become the guest's permanent home.
Bookings made on Airbnb, Booking.com or Expedia are also governed by that platform's terms and the cancellation policy shown there.
2. How to book
- Choose your dates and number of guests in the booking calendar (managed by Smoobu).
- Before paying, you will see the total price, the cancellation terms and these terms.
- Enter your details and pay by card (processed by Stripe).
- Your booking is confirmed when you receive our confirmation email, which includes the booking details and these terms.
The person booking must be at least 18 years old and is responsible for making sure all guests know and follow these terms. The contract may be concluded in Spanish or English.
3. Your stay
- Maximum occupancy: 6 guests (children included, infants too).
- Minimum stay: 4 nights.
- Check-in: from 16:00. Check-out: by 10:00.
- Long stays of up to 3 months on request, always for holiday or tourist purposes.
- Discounts for stays of 15 and 30 nights or more, shown in the price when booking.
4. Prices and taxes
Prices are in euros. The total price shown before payment is the final price and includes all mandatory charges (e.g. final cleaning) and applicable taxes, including the Canary Islands General Indirect Tax (IGIC) where applicable. No additional mandatory amount will be charged that was not shown before payment.
5. Payment
The full price (100%) is paid by card via Stripe at the time of booking. We do not store your card details.
6. Cancellation and refunds
Right of withdrawal: as this is an accommodation service for specific dates, there is no 14-day right of withdrawal (Article 103(l) of the Spanish Consumer Protection Act, TRLGDCU, implementing Article 16(l) of Directive 2011/83/EU).
24-hour grace period: you may cancel free of charge within 24 hours of the booking confirmation (for example, if you chose the wrong dates) and we will refund 100% of the amount paid.
After 24 hours: the booking is non-refundable. If you cancel, do not show up or leave early, the amount paid will not be refunded, except as provided in this section or by law. We recommend taking out travel insurance that covers cancellation.
If we cannot provide the accommodation (for a reason attributable to us or due to force majeure that makes the stay impossible), we will offer you new dates. If you do not accept them, we will refund in full the amount paid for the nights not provided, without prejudice to any other rights you have under the law.
Other cases: where the law requires a refund for reasons not attributable to us, we may only deduct costs actually incurred and documented, to the extent permitted by law.
Refunds are made using the original payment method within 14 days of being agreed.
7. Guest obligations
- Provide, before or on arrival, the details and ID documents of all guests required by Royal Decree 933/2021 (guest registration). Without them we cannot accept the stay.
- Not exceed the maximum number of guests and not transfer or sublet the property.
- Use the property with care, respect the neighbours' rest, the house rules and community rules, and leave the property in a reasonable condition.
- Inform us as soon as possible of any breakdown or damage.
8. House rules
- No parties or events.
- No smoking indoors.
- Pets: allowed, maximum 1 pet.
- Quiet hours: 23:00 to 08:00, in line with local by-laws.
- Visitors not included in the booking require our prior permission.
A serious breach of these rules (e.g. over-occupancy or parties) may lead to termination of the contract and departure from the property without refund of the remaining nights, without prejudice to liability for damage.
9. Liability
Guests are liable for damage that they or their companions cause to the property or its contents intentionally or through negligence, beyond normal wear and tear.
We are responsible for the proper condition of the property and the provision of the service in accordance with the law. We are not liable for the loss of personal belongings not entrusted to our care, or for utility interruptions (water, electricity, internet) beyond our control, although we will do our best to fix them quickly. Nothing in these terms limits your statutory consumer rights or our liability for intent or gross negligence.
10. Complaints
If something goes wrong, email us at oceanview@villadenava.es or call or send a WhatsApp message to +34 639 750 788; we will try to solve it as soon as possible. We will answer complaints as quickly as possible and in any case within one month.
Official complaint forms (hojas de reclamaciones) are available at the property, in accordance with Canary Islands tourism regulations. You can also file an electronic complaint through the Canary Islands Government's online services (sede electrónica).
We are not part of any alternative dispute resolution scheme.
11. Applicable law and courts
The contract is governed by Spanish law. As this is the rental of a property located in Tenerife, disputes arising from it will be settled by the courts of the place where the property is located (Tenerife, Spain), which have jurisdiction under Article 24(1) of Regulation (EU) No 1215/2012, unless a mandatory rule provides otherwise. If you are a consumer, the mandatory consumer protection rules that apply to you are always respected. If you are not a consumer (for example, a company booking for business purposes) and the law allows it, both parties submit to the courts of Madrid (Spain).
